Freeway App Privacy Policy

Freeway App understands that your privacy is important. The purpose of the Freeway Privacy Policy is to inform our users about the information that we collect, how we use that information and how that information is used or shared.

This Privacy Policy is effective as of May 27th, 2014. It applies to our website, applications, mobile devices and all mediums.

Freeway App, is a service that lets users of smartphones and other mobile devices play fun games at a chance to win rewards (the "Service"). The Service, along with our website at www.playfreeway.com (the "Site" and, together, with the Service, our "Services") is owned and operated by Freeway App, Inc. (“"Freeway App," "we,"" or "us"). This Privacy Policy (this "Policy") describes what information we gather from you on the Services, how we use and disclose that information, and what we do to protect it. By using the Services, you expressly consent to the information handling practices described in this Policy.

At any given time, Freeway App , and/or certain business entities with which Freeway has contracted or vendors providing prizes (each, a “Sponsor") will be sponsoring various promotions on the App (each a "Promotion", and collectively, the "App Promotions"). Each promotion is subject to these terms and official rules except as expressly stated in writing in a given promotion description.

This Policy is incorporated into and is subject to the Freeway App Terms of Service, available at playfreeway.com/terms. The practices described in this Policy apply only to our use of information supplied by you to us through the Services. Information collected from you by others, such as third-party web sites that you may access through links on the Service, may also be governed by those third parties’ privacy policies.

How Information is collected

"Personal information," as used in this Policy, is information that specifically identifies an individual, such as an individual's name, address, telephone number, or e-mail address. Personal information also includes information about an individual's activities, such as information about his or her activity on our Services, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked directly to personal information that identifies that individual. This section describes the personal information and other information we collect on the Service. User-Provided Information: You need to register in order to maintain points in an account and to redeem prizes that you earn on the Service. You can register with us by using a valid phone number through a confirmation code that is sent via SMS text. Also, we may offer the ability to connect to Third-Party Connected Services (as defined below in the "Third-Party Connected Services" section of this Policy).

We may also provide you with other opportunities to voluntarily provide personal information to us on the Services, such as through feedback or customer support forms, surveys, user profile functionality, or other means.

"Automatically Collected" Information: In addition, the Services may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile devices unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Services.

"Location Information” The Service may offer features designed to target advertisements or other content to you based in whole or in part based on your location. The Service may also make suggestions to you based in whole or in part based on your location. You will be given the opportunity to opt out of location-based functionality on the Service, normally through an opt-out screen. If you do not opt out of location-based functionality on the Service, we may collect your location based on information provided by you or your mobile device, including, if available, GPS, IP address or cell tower information. If you choose to disable location-based functionality on the Service, you may not be able to utilize certain features of the Service.

The Ways we Use Information:

Generally, we use the information that you provide or that we collect and/or aggregate, including personal information, "automatically collected" information, and other information, to: (i) administer, operate, and improve the Services and our other services and systems; (ii) personalize the content and information on the Services, (iii) monitor and analyze the effectiveness of the Service and marketing activities on the Services (including by third parties), (iv) understand and analyze the usage trends, interests, and preferences of our users, (v) track your entries, submissions, and status in any promotions or other activities that may be offered on the Services from time to time, and (vi) create new features, functionality, products, and services. We may also use personal information for any other purposes that we may disclose to you in connection with a request for your personal information, and for any other use for which you may provide your consent. We will use your provided contact information to contact you for administrative purposes and for customer service purposes. We may also use your contact information to send you advertisements and promotions regarding our products and services and those of third parties. We may use location information that you provide or that we collect to provide content (including, without limitation, advertisements) and services to you based in whole or in part on your location. We may use information that you provide to us or that we collect through the Services, including personal information, to tailor and provide advertising and other content to you.

When We Disclose Information:

We may disclose User Provided and Automatically Collected Information: as required by law, such as to comply with a subpoena, or similar legal process; when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, to investigate fraud, or respond to a government request; with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this Privacy Policy; if Freeway App is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Services of any change in ownership or uses of this information, as well as any choices you may have regarding this information; and to advertisers and third party advertising networks and analytics companies as described below under the Section entitled "Automatic Data Collection and Advertising".

Automatic Data Collection and Advertising

We may work with analytics companies to help us understand how the Services is being used, such as the frequency and duration of usage. We work with advertisers and third party advertising networks, who need to know how you interact with advertising provided in the Services which helps us keep the cost of the Services free. Advertisers and advertising networks use some of the information collected by the Services, including the unique identification ID of your mobile device and your mobile telephone number. To protect the anonymity of this information, we use an encryption technology to help ensure that these third parties can't identify you personally. These third parties may also obtain anonymous information about other applications you've downloaded to your mobile device, the mobile websites you visit, your non-precise location information (e.g., your zip code), and other non- precise location information in order to help analyze and serve anonymous targeted advertising on the Services and elsewhere. We may also share encrypted versions of information you have provided in order to enable our partners to append other available information about you for analysis or advertising related use. If you'd like to opt-out from third party use of this type of information to help serve targeted advertising, please visit the section entitled "Opt-out" below.

Choices and Access:

You can stop all collection of information by the Services easily by uninstalling the Services. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at privacy@playfreeway.com

Data Retention Policy, Managing Your Information

We will retain User Provided data for as long as you use the Services and for a reasonable time thereafter. We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Services, please contact us at privacy@playfreeway.com and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Services to function properly.

Third Party Connected Services

The Services uses social media plug-ins and applications to allow you to post information about Freeway and your activities on the Services on your social media accounts, such as Facebook and Twitter. If you choose to use these plug-ins and applications, Freeway may get information about your user name and profile. By using these plug-ins and applications you grant us permission to access your social media profile information and to use it in accordance with the terms of use for that social media website and this Privacy Policy. Any personal information shared via any social media accounts may become public information. You should exercise caution when disclosing information in these public areas, especially your location data, and be careful how you disclose your personal information. Content posted in public areas of our Services and social media pages, including advice and opinions, represents the views and is the responsibility of those who post the content. Please refer to the privacy settings of the social media website or application to determine how you may adjust our permissions and manage the interactivity between Freeway and your social media account.

The Services may contain links to other Web sites, products, or services that we do not own or operate. If you choose to visit or use any third-party products or services, please be aware that this Policy will not apply to your activities or any information you disclose while using third-party products or services or otherwise interacting with third parties. We are not responsible for the privacy practices of these third-party websites and services. We encourage you to carefully review the privacy policies applicable to any Web site or service you visit before providing any personal information on them.

Our Commitment to Children"s Privacy

We do not use the Services to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at privacy@playfreeway.com We will delete such information from our files within a reasonable time.

Data Security:

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Services. Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

International Visitors

The Services are hosted in the United States and are intended solely for visitors located within the United States. If you nonetheless choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, please be aware that you are transferring your personal information outside of those regions to the United States and, by providing your personal information on the Services, you consent to that transfer.

Business Transfers

In the event that all or a portion of Freeway App or its assets is acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer and/or assign the information that we have collected from users, including personal information, in connection with such merger, reorganization, recapitalization, acquisition, sale, or other change of control.

Changes and Updates to this Policy

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or text message. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

NOTICE TO CALIFORNIA RESIDENTS

Your California Privacy Rights. California Civil Code Section 1798.83 permits California residents who have provided personal information to us or our third party advertisers and marketing partners, if any, to request certain information regarding our disclosure of personal information to third parties for direct marketing purposes. Requests should be submitted via email to [Insert Privacy email link] and should include CALIFORNIA PRIVACY RIGHTS in the subject line. We will need your first and last name, mailing address and email address in order to process your request. Within thirty days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for direct marketing purposes during the immediately preceding calendar year, if any, along with the names and addresses of these third parties, if any. Please be aware that not all information sharing is covered by the requirements of Section 1798.83 and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year.
